Certificate of ownership of real estate

There is a unified system in the country concerning the execution of the necessary documents for the right of ownership of real estate. The main state body that deals with the implementation of procedures related to the execution of documents for real estate is the cadastral office.

The validity and legality of the transaction is guaranteed directly at the state level. Each purchase and sale transaction is necessarily registered in a special registry journal, where the purchasing person or organization receives a registration number that allows identifying the acquired property. Documents that reflect the fact of the sale or purchase of housing are stored in certain archives of the state land cadastre office itself and the state registration chamber.

The only valid document confirming the right of ownership of a specific real estate object is “a certificate of ownership of real estate” – or Tapu in Turkish. Owners of real estate objects have the right to act both as individuals or groups of individuals, as well as legal entities.

The procedure for registering the acquisition of real estate

Agreement on the purchase and sale of a house, apartment or any other real estate.

This agreement is concluded between the seller and the buyer of the property. As intermediaries in the purchase and sale, consultants will certify the fact of the transaction

The contract must necessarily contain the following provisions:

  • Information about the seller and the buyer
  • Information about the real estate object, which is the subject of the contract (floor layout, construction features, date of commissioning of the building, etc.)
  • Terms of payment
  • Legislative and legal procedures

Required documents:

  • Three photographs (their size must be 3x4 cm.)
  • Two copies of a photocopy of a passport or ID personalities
  • Mother's and father's surnames, their names both on the buyer's side and on the seller's side

Obtaining the so-called individual taxpayer number

When do you get an individual taxpayer number? As a rule, you can get it immediately upon presentation of your passport at any local tax office. Having such a number is a mandatory requirement when registering any real estate, when opening a bank account, as well as when concluding contracts for the provision of telephone services that we so need, and so on.

Opening a bank account

A bank account can be opened in the buyer's name at any Turkish bank. As a result, the procedure for transferring the amount of money to pay for the purchased property is significantly simplified. In addition, there is an opportunity to minimize various routine hassles of paying water, electricity and telephone bills by instructing the bank to automatically make such payments using your bank account.

At the client's request, a notarized power of attorney can be issued

Any buyer of property has the opportunity to instruct a real estate consultant to handle all matters (official procedures) on their behalf. This may include submitting documents to the state registration chamber, paying all subscriber bills, for example, for telephone services and electricity. In addition to the consultant, the power of attorney may be issued to another person indicated as the buyer's representative. The main thing is that the power of attorney is notarized and drawn up for the consultant or another person.

Required permits from various government agencies

This is an official request for alienation of a certain real estate object into ownership, which is submitted to the state registration chamber (its local office) of the district or territorial-administrative entity within which the specified object is located. The purpose of submitting such a request is to confirm that the property being purchased is not located on territory owned by the army and used by it for its own needs. Currently, there is no longer a need to obtain permission from the military department in Turkey if a request to purchase properties on the same site has already been considered based on someone's application at least once since May 5, 2011. Thus, in the vast majority of cases, the process of obtaining a permit is formal and takes several days instead of 6-8 weeks as before.

Transfer of ownership to the owner of the property

After receiving all the necessary permits provided by government agencies, the long-awaited ownership of a certain property is transferred to the buyer from the seller directly in the offices of the state registration chamber. The presence of an officially accredited translator is mandatory. Such a procedure can be carried out by a representative authorized by the buyer or seller, or by both parties, if there is a notarized power of attorney.
