Rental Income After Property Sale Goes to New Owner

Türkiye’s Supreme Court of Appeals has issued a ruling that is important for owners of rental properties. If a property is sold after rent for a future period has already been paid to the previous owner, the amount covering the period after the sale must be transferred to the new owner.

The ruling was issued by the Third Civil Chamber of the Supreme Court of Appeals of Türkiye. The court overturned a local court decision in the interests of the law.

Important: The ruling concerns rental payments specifically related to a period after ownership of the property has been transferred to the new owner.

How the dispute between the former and new owners began

According to the published ruling, a resident of Ankara, identified as Y.O., purchased a house from B.K. on December 18, 2023.

After purchasing the property, the new owner requested rental payment from the tenant for the relevant rental period beginning on December 15. However, the tenant said that the rent had already been paid to the previous owner, B.K.

Y.O. then demanded that the former owner return the amount corresponding to the period after the property had been sold. B.K. refused, and the new owner took the matter to court.

What did the local court decide?

The case was heard by the Civil Court of First Instance in Ankara. The local court rejected the new owner’s claim.

The court argued that B.K. had been the owner of the property when the rental payment was received and therefore had been entitled to collect the money.

In other words, the local court considered the timing of the payment rather than the rental period to which the payment related.

The Supreme Court overturned the decision

Türkiye’s Ministry of Justice considered the local court’s decision unlawful and requested that it be overturned in the interests of the law.

The Third Civil Chamber of the Supreme Court of Appeals reviewed the case and overturned the local court’s decision.

If rent was paid in advance and the property was subsequently sold, the amount corresponding to the period after the date of sale must be paid to the new owner.

What does the ruling mean for property owners in Türkiye?

The decision is particularly relevant to owners of apartments, houses and other properties that are rented out.

When selling a rental property, it is important to consider not only the property itself and the date of the ownership transfer, but also rental payments that have already been collected. If the previous owner received rent in advance for a period that falls after the buyer became the owner, that payment must be settled with the new owner.

  • Check which rental period has already been paid for before selling a rental property.
  • Take the date of ownership transfer into account.
  • If part of the rent received by the previous owner relates to a period after the sale, that amount must be transferred to the new owner.
  • When purchasing a property with an existing tenant, clarify the status of rental payments in advance.
  • The seller and buyer should document how information about previously paid rent will be transferred as part of the transaction.

For property owners: Receiving rent in advance does not automatically mean that the previous owner can keep the entire amount after selling the property. The rental period covered by the payment must be taken into account.

Why is the decision important for the real estate market?

The sale of a property that is already rented requires consideration of both the purchase agreement and the existing rental relationship. Such transactions can raise questions about who is entitled to rental payments that have already been made and how those amounts should be divided between the former and new owners.

The new Supreme Court ruling provides an important reference for such disputes: rental income should be linked to the relevant period of use of the property and the ownership rights applicable during that period.

For investors purchasing property in Türkiye specifically to generate rental income, this issue is especially important. Before completing a transaction, buyers should check not only the property documents but also the existing rental agreement, payment schedule and any advance rental payments.

What to check before buying a rental property

  1. The current rental agreement and its validity period.
  2. The monthly rental amount.
  3. The date of the tenant’s latest payment.
  4. Whether rent has been paid in advance for several months.
  5. The period covered by any rental payment already made.
  6. The date when ownership will be transferred to the buyer.
  7. How information about rental payments will be provided to the buyer.

🏠 When buying or selling a rental property in Türkiye, rental payments should therefore be considered separately from the property transaction itself. The Supreme Court of Appeals has confirmed that rental income covering a period after the sale belongs to the new owner.

For investors, checking rental payment records before completing a property transaction can help prevent disputes between the buyer, seller and tenant.
