TikTok Beach Livestream in Alanya Raises Privacy Questions
A TikTok livestream filmed on a beach in Alanya has sparked discussion about the legal boundaries of filming tourists and publishing their images online without their knowledge.
According to local media reports, a TikTok user known as Yasmin, reportedly associated with one of the hotels in Alanya, livestreamed from a beach while holidaymakers appeared in the background. The situation attracted additional attention after viewers posted vulgar comments about women who were visible in the broadcast.
During the livestream, the creator also encouraged viewers to send virtual gifts through TikTok.
The key question is whether the people appearing in the livestream were aware of the filming and whether there was a legal basis for publishing their identifiable images online.
Why Filming on a Beach Can Become a Legal Issue
The fact that a person is in a public place does not automatically mean that their image can be filmed, stored and broadcast online without restrictions.
Türkiye's Personal Data Protection Authority, KVKK, has previously examined the issue of live internet broadcasts from streets, squares, parks and beaches. The authority has noted that people may still have a reasonable expectation of privacy even when they are in public spaces.
If a person can be identified from a video, their image may be considered personal data under Law No. 6698 on the Protection of Personal Data.
The issue is not limited to the act of filming itself. Recording, storing, publishing, transferring or livestreaming an identifiable person's image to an unlimited audience may also constitute processing of personal data, depending on the circumstances.
Being in a Public Place Does Not Mean Automatic Consent
KVKK guidance indicates that simply being in a public space does not constitute automatic consent to any use of a person's personal data.
For example, the authority has considered the use of municipal cameras for online tourism broadcasts. In relation to beaches, promenades and other recreational areas, the circumstances of the processing and people's expectations of privacy can be relevant when assessing whether the use of images is lawful.
However, whether a specific situation constitutes a violation depends on factors such as the purpose of processing, whether the person can be identified, the circumstances of the filming and whether another legal basis for processing exists.
KVKK Administrative Fines in 2026
Administrative fines under Law No. 6698 were increased for 2026 following annual indexation.
According to the official KVKK figures, the maximum administrative sanction for certain violations can reach:
₺17,092,242
This upper limit applies to certain violations, including some obligations related to personal data security, failure to comply with KVKK Board decisions and specific registration-related duties.
Important: ₺17.09 million is not an automatic fine for filming or photographing a person without consent. The applicable sanction, if any, depends on the specific violation, the circumstances of the case and the outcome of an official assessment.
Examples of KVKK Administrative Fines for 2026
- 📋 Failure to fulfil the obligation to inform: ₺85,437 to ₺1,709,200;
- 🔐 Violations related to personal data security: ₺256,357 to ₺17,092,242;
