Watch out! A fine of one million Turkish Liras!

As many already know, a new law on short-term rentals came into effect in Turkey on January 1, 2024. This law regulates the procedures and principles for renting properties for short periods—less than 100 days. Long-term contracts (100+1 days) are not covered by this law. Here are the main conditions of this law:

1. Licensing Requirement: To rent out property for short terms, one must obtain a license from the Ministry of Culture and Tourism. This responsibility falls on the owner and can be done through the e-devlet website of the owner or by proxy through a Turkish citizen’s e-devlet to whom the power of attorney has been granted. The Ministry of Tourism reviews applications within a period of 1 to 3 months. The cost of obtaining this license is 12,700 TL (approximately 400 euros).

2. Unanimous Owner Consent Required: To obtain a license for short-term rental, unanimous consent from all property owners is required. In residential complexes with multiple buildings, only the consent of the owners of the building where the property is located is needed. For properties with separate infrastructure (Yüksek Nitelikli konutlar), it is not necessary to have 100% owner consent, but the management plan (YONETİM PLANI) must specify that short-term rentals are allowed. Practically, there are few such properties because this was not previously required. The charter can be changed with a 4/5 majority vote of the owners.

3. Subleasing Prohibited: It is not allowed to rent a property long-term and then sublease it to tourists on a daily basis. Only the property owner who has obtained the license or a licensed agency holding an A-category license can engage in this business. Our agency holds such a license.

4. Post-License Requirements: After obtaining the license, a sign issued by the Ministry of Tourism must be displayed at the property entrance. Government officials will conduct inspections of complexes engaged in daily rentals. Residences applying for a permit must comply with the following rules: Each apartment must have at least one bed, toilet, bathroom, living room, and kitchen. There must be cold and hot water, quality bedding, one pillow, one sheet, and, depending on the climate conditions, a cover or down comforter per person. Each bathroom must have a face towel and a bath towel per person. Fire extinguishers and fire detectors must be present in all rooms except bathrooms and toilets. An evacuation plan must be displayed on the front door. Information about the complex's rules and the apartment's living regulations must be available. Furniture, finishes, equipment, and appliances used in the home must meet standards (clean, well-maintained, and in working condition). The capacity of the apartment allows for two people per bedroom, with a maximum of two additional people allowed (e.g., if the apartment is 1+1, then two people in the bedroom and two in the living room).

Complexes with Separate Infrastructure Requirements: Reception, security, cleaning service, laundry, dining services (cafe, store), gym, and pool.

Violators are subject to administrative fines ranging from 100,000 to 1 million TL (3,300-33,000 euros).
