All transactions of real estate in Turkey are reliable

So you've decided to buy a property in Turkey; you have already made your choice and then came to this country for fulfilling some formalities. Do not relax despite the alluring beaches, beautiful palm trees and hot sun. After all, you came to decide important issues. Undoubtedly, each buyer wants to get a guarantee of fairness of sales transaction.

We can suggest on some indicators that you should pay attention when buying a new home, cottage or villa. They are:

• Relevance of buying property’s data with TAPU;

• A buying property must not be a common property;

• If the owner is a physical figure, you should know whether the identity of the owner is specified in TAPU;

• You should know if the owner of the property was not seized or had other restrictions written in TAPU (mortgages, for example);

• If apartment is to be purchased in a newly built complex, you should find out if the developer had a license, whether the building is in accordance with all the standards and regulations;

• You should find out whether the current owner had debts to utilities or taxes unpaid;

• If buying object is rented, you certainly should be familiar with the terms of lease.

Studying the contract of sale, pay attention to the existence of such items as:

• Description of the property (ie the address and TAPU registration number, etc.);

• The cost of acquisition;

• Bank details and seller/agency contact information;

• Terms and conditions of payment;

• Conditions of force majeure,

• Conditions for cancellation of the transaction;

• Detailed description of all inclusive furniture (if you’re buying a furnished apartment);

• Stability in informing both the buyer and the seller about all  the production of cases in TAPU,

• Main conditions of consideration of all possible disputes in the future;

• The contract must be made up in 2 languages.

When you sign a contract and execute the rights of ownership of real estate, it is important for you to demand from company-seller a special document (IMZA SIRKÜLERI); different types of advance payment should be accompanied by a receipt (Makbuz). Do not rely on every person; believe only professionals and legal documents.
